2. Quotations and Estimates
2.1. All quotations are based on the information available to us at the time the quotation is prepared.
2.2. Unless otherwise stated in writing, quotations are valid for [30] days from the date of issue.
2.3. A quotation is not binding until it has been accepted by you and any required deposit has been paid.
2.4. The quotation will specify the goods, materials, design services and/or kitchen installation services included in the proposed contract.
2.5. Items or services not specifically included in the quotation will be charged separately.
2.6. If measurements, site conditions, product availability, supplier prices, or other circumstances change before the order is placed, we reserve the right to amend the quotation. Any material change in price will be notified to you before we proceed.
3. Acceptance of Orders
3.1. An order becomes binding once we have confirmed acceptance of the order in writing and received any applicable deposit.
3.2. Once an order has been placed, certain goods may be specially ordered, made to measure, or manufactured specifically for you. Such goods may not be capable of cancellation or return except where required by law.
3.3. We reserve the right to refuse an order where goods are unavailable, discontinued, or cannot reasonably be supplied.
4. Kitchen Design and Specifications
4.1. Kitchen designs, plans, drawings, and computer-generated images are prepared based on the measurements and information available to us.
4.2. Visual representations are for illustrative purposes. Colours, finishes, textures, lighting, and dimensions may vary from the final products.
4.3. You are responsible for checking and approving the final design, layout, colours, finishes, appliances, and specifications before placing the order.
4.4. Once you have approved the final design and specifications, changes may result in additional costs and/or delays.
4.5. Unless expressly stated in writing, our design service does not include architectural or structural engineering, building control planning, or specialist electrical/gas certification services.
5. Measurements and Site Conditions
5.1. Where we undertake a site survey, we will take reasonable care to obtain accurate measurements.
5.2. You acknowledge that concealed conditions may not be apparent before work begins, which may include uneven walls or floors, hidden pipes, wiring, structural issues, damp, asbestos, or other unforeseen conditions.
5.3. If unforeseen site conditions require additional work or materials, we will notify you where reasonably practicable and agree on any additional costs with you before carrying out the additional work, except where immediate action is reasonably necessary to protect people or property.
5.4. Where measurements or information are supplied by you or another contractor, you remain responsible for their accuracy unless we have expressly agreed otherwise in writing.
6. Prices
6.1. Prices will be stated in the quotation and will specify whether VAT is included.
6.2. Unless expressly stated otherwise, the price does not include work or materials outside the scope of the quotation.
6.3. Additional work requested by you will be charged at the agreed price or, where no fixed price has been agreed, at our applicable labour and material rates.
6.4. Where supplier price increases occur after an order has been placed but before goods are supplied, we will only seek to pass on such increases where permitted by applicable law and our agreement with you.
7. Deposits and Payment
7.1. A deposit of 40% may be required when an order is placed.
7.2. The remaining balance will become due in accordance with the payment schedule stated on your quotation or invoice.
7.3. We may suspend or delay delivery or installation where payment due has not been received.
7.4. If payment is overdue, we reserve the right to charge interest and recover reasonable costs to the extent permitted by law.
7.5. Unless otherwise agreed in writing, all goods remain our property until we have received payment in full for those goods.
8. Delivery
8.1. We will provide an estimated delivery date or delivery period where possible.
8.2. Delivery dates are estimates unless we have expressly agreed on a fixed delivery date in writing.
8.3. We will not be responsible for delays caused by circumstances beyond our reasonable control, including supplier delays, transport issues, severe weather, strikes, shortages, or other events outside our reasonable control.
8.4. You must ensure that suitable access is available for delivery and that the property is reasonably accessible and safe.
8.5. Where delivery requires specialist access, lifting equipment, parking arrangements, or other additional services, these may incur additional charges.
9. Installation Services
9.1. Where kitchen installation services are included, the scope of installation will be set out in the quotation.
9.2. Unless specifically included, installation does not include structural alterations, major plumbing alterations, rewiring, gas work, plastering, decorating, flooring, asbestos removal, building work, or other specialist works.
9.3. Gas and electrical work will only be carried out by appropriately qualified persons where such work is included within our agreed scope.
9.4. You must ensure that the property is reasonably clean, accessible, secure, and suitable for installation.
9.5. Existing appliances, plumbing, electrical installations, flooring, walls, ceilings, and other existing features may require additional work if they are unsuitable for the new kitchen.
9.6. We will take reasonable care while carrying out installation work but cannot be responsible for defects or damage arising from pre-existing conditions that were not reasonably visible before work commenced.
10. Customer Responsibilities
You agree to:
- Provide accurate information necessary for the design and kitchen installation services;
- Give us reasonable access to the property;
- Ensure that utilities required for the installation are available;
- Remove personal belongings and items that may obstruct the work;
- Obtain any permissions, consents, or approvals that are your responsibility;
- Notify us of any known structural, electrical, plumbing, asbestos, or other property issues;
- Ensure that any required parking or access arrangements are available; and
- Inspect and approve the completed work within a reasonable period.
11. Changes and Variations
11.1. Any changes requested after the order has been confirmed may be subject to additional charges.
11.2. Changes may also affect delivery and installation timescales.
11.3. We will confirm significant variations and associated costs with you before carrying out the additional work.
11.4. Where a change affects goods that have already been manufactured, ordered, or delivered, you may remain responsible for the cost of those goods.
12. Cancellation and Consumer Rights
12.1. Nothing in these Terms and Conditions affects any statutory rights you may have as a consumer.
12.2. If you are a consumer and the contract is entered into away from our business premises or online, you may have cancellation rights under applicable consumer protection legislation.
12.3. Certain cancellation rights may not apply to goods that are made to your specifications or are clearly personalised, subject to applicable law.
12.4. Where installation or other services begin during a statutory cancellation period at your express request, you may be required to pay for services properly performed before cancellation, where permitted by law.
12.5. Cancellation requests should be made in writing.
13. Defective, Damaged, or Incorrect Goods
13.1. You should inspect goods as soon as reasonably possible following delivery.
13.2. If goods arrive visibly damaged, you should notify us as soon as reasonably possible and provide photographs where appropriate.
13.3. If goods are faulty, defective, or not as described, we will deal with the matter in accordance with your statutory rights and any applicable manufacturer warranty.
13.4. We will not exclude or limit any legal rights you have regarding faulty, unsafe, or misdescribed goods.
14. Warranties
14.1. Manufacturer warranties may apply to appliances, cabinets, worktops, hardware, and other products supplied by us.
14.2. The terms and duration of any manufacturer's warranty will depend on the relevant manufacturer and product.
14.3. Installation workmanship may be covered by a separate workmanship warranty where stated on your quotation or invoice.
14.4. Warranties may not cover damage caused by misuse, accidental damage, improper maintenance, alterations by third parties, or normal wear and tear.
15. Worktops and Natural Materials
15.1. Natural stone, timber, quartz, and other natural or semi-natural materials may contain variations in colour, pattern, texture, and appearance.
15.2. Such variations are not necessarily defects.
15.3. Worktops may require templates, specialist fabrication, and installation; final measurements may therefore be confirmed after the kitchen units have been installed.
16. Appliances
16.1. Appliance specifications, availability, and delivery times may be subject to manufacturer and supplier availability.
16.2. Manufacturer warranties generally apply directly to appliances.
16.3. Unless specifically included, connection, disconnection, or installation of appliances is not included.
